What is are the first things I should do if involved in a motor vehicle accident (MVA)?
Answer: Obviously you want to take all precautions to protect your physical well being and that of others. If there are ANY injuries of any type, no matter how slight, call for help by dialing 911 or calling for an ambulance.
Should I call for a law enforcement officer to investigate the MVA?
Answer: Yes, absolutely! No matter how slight the accident, you should make certain a law enforcement officer investigates and writes a report. Otherwise, there will very likely be a dispute later as to what happened. Make certain the officer hears your version of the MVA and why you were not at fault. Never voluntarily offer any information which would tend to place you at fault unless you are absolutely certain you want to take the blame. Be sure that the investigating officer knows you were wearing your seatbelt at the time of the MVA.
What law enforcement officers investigate which MVAs?
Answer: Generally, MVAs on state or federal highways are investigated by the Mississippi Highway Patrol, while those on city streets are investigated by city policemen. If a wreck occurs on a county road (gravel or paved) it will probably be investigated by a Sheriff's deputy, although there if frequently overlapping jurisdiction and more than one agency may investigate any MVA.
Is there any specific information I should make certain I get at the time of the MVA?
Answer: Yes. The following are things you should record if at all possible:

Addresses and phone numbers of anyone else who might have knowledge of any aspects of the MVA |

If you have a camera, take photos, or get someone else to do so. Ask the law enforcement officer to take photos if necessary. You cannot take too many. |

Make a note of any statements made by persons in the "other" car which caused the MVA. |

Try to remember what everyone was wearing at the time. If you can remember that, it will give credibility to your other remembrances about the wreck. |

Remember speed limits of the location, and any special physical features. |
Does it matter how soon I call my attorney?
Answer: It is VERY important that you call your attorney as soon as you have an opportunity to do so. Time is precious when trying to gather physical information and data from the site of the MVA and the vehicles. The longer you wait, the less chance for obtaining evidence that could be important. Our firm will go to you whether it is in a hospital or in your home or wherever is necessary.
Should I give statements to any investigators or insurance adjusters?
Answer: NO! You are not required to talk to anyone from an insurance company or anyone working for an insurance company at any time. And you should absolutely refuse to do so which you have very right to do. Any statement you make will frequently be used against you, and it is difficult to take back something once you have it recorded. (And the insurance adjusters will probably be recording your statement either by phone or in person.)
